Yet another dumb SCOTUS ruling; Rep James Fagan says he’ll “rip apart” child molestation victims. What a great country.
States’ rights, people! The death penalty is perfectly justifiable for rape, especially child rape! What the heck is wrong with this country?
“The death penalty is not a proportional punishment for the rape of a child,” Justice Anthony Kennedy wrote in his majority opinion. His four liberal colleagues joined him, while the four more conservative justices dissented.
…”The harm that is caused to the victims and to society at large by the worst child rapists is grave,” Alito wrote. “It is the judgment of the Louisiana lawmakers and those in an increasing number of other states that these harms justify the death penalty.”
But Kennedy said the absence of any executions for rape and the small number of states that allow it demonstrate “there is a national consensus against capital punishment for the crime of child rape.”
There is? Really? I’m not so sure. Even in prison, child molesters have to be kept out of the general population lest they be beaten to death by the other criminals.
This isn’t even morally defensible. It’s not.
Honestly, rape is one of the worst things one can do to someone else. It ruins their life FOREVER. And to so abuse a child, to rob them of their innocence so violently, so evilly…Only a monster could do such a thing. A child!
Via the AP,
Rape and other crimes “may be as devastating in their harm, as here, but ‘in terms of moral depravity and of the injury to the person and to the public,’ they cannot be compared to murder in their ‘severity and irrevocability,’” Kennedy said, quoting from earlier decisions.
No, no, sure it can’t.
* head bursts *
The decision was also attributed to “evolving standards of decency in a maturing society”. WHAT!?! Are you kidding me? I’m sorry, when did I miss the “It’s A-okay to rape a child now” memo? Was it on CNN when I wasn’t looking? Are we suddenly an Islamic country? This is an outrage. Justice Kennedy is an outrage. If allowing child rapists to live means we’re maturing, send America back to nursery school, PLEASE. I don’t want to live here anymore if this makes us “mature” or “decent”. Do you?
Louisiana governor Bobby Jindal is furious as well:
“The opinion reads more like an out-of-control legislative debate than a constitutional analysis,” said Louisiana Gov. Bobby Jindal, a Republican. “One thing is clear: The five members of the court who issued the opinion do not share the same ‘standards of decency’ as the people of Louisiana.”
Amen, brother. As if to rebel against the obviously brain-dead SCOTUS, Jindal has signed a “Sex Offender Chemical Castration Bill”, which allows the castration of convicted sex offenders. It’s not totally mean, though: they get to choose if they want it done chemically or physically. Who says we conservatives aren’t for choice? Good for him.
(Have I mentioned I really like Bobby Jindal? Were he to run for Pres, he’d have my resume in my hands before he could finish the announcement…and doubtless mine would not be the only one there at the speed of light.)
And for all the die-hard, “murder shouldn’t be against the law!” libertarians gnashing your teeth, remember: “… if you do wrong, be afraid, for he does not bear the sword in vain. For he is the servant of God, an avenger who carries out God’s wrath on the wrongdoer.” This is hardly a case of overbearing government; we’re not talking about punishing people for, say, preaching the Gospel or using lethal force to defend one’s family. Get over your pie-in-the-sky utopian ideals; it’s not rational and certainly not Biblical until the real Kingdom arrives.
Of course, this is the same country where Taxachusetts rep James Fagan can say this about child molestation victims:
“I’ll rip apart 6-year-old victims on the witness stand and make sure the rest of their life is ruined.
“When they’re 8 years old they throw up; when they’re 12 years old, they won’t sleep; when they’re 19 years old, they’ll have nightmares and they’ll never have a relationship with anybody.”
Oh, yes he did:
This rant was in regard to “Jessica’s Law“. Nice guy.
What the heck are we, Saudi Arabia? Sick, sick, sick. And sad.
If God personally reaches down and crushes the Court building, I can’t say I’ll be really devastated.
Justices Thomas, Alito, Scalia, Roberts…maybe y’all should take the rest of the week off? Come on up to West Virginia, we can have a barbeque. So to speak.
Sick, sick, sick. Enraging.

Too bad we already know that the majority of the “justices” (I use that term lightly) have proven their lack of concern towards the “most innocent” in our society. Now this. Oh, and terrorists have more rights than our children, too. So not only does LA have to pay to keep these two guys in prison indefinitely, but there literally is NO justice for those children they brutally raped. And we wonder why kids are growing up killing other kids and going on murder sprees …
So well stated, my friend. I read about this yesterday and commented briefly from my mommy’s heart about the harm done to the child. States’ rights ran through my head, but to comment on that would have required more time than I had and, too, I knew you would do it so much more eloquently than I (others know this as well, seeing the comment above!) …
Oh, and when (!) Jindal runs for President, may I submit my resume to be your assistant? He’s got wonderful clarity about what this country needs, you’d be a major asset to his staff, and I’d be perfectly happy to run errands, get coffee, whatever, to free up ya’ll’s time to get him elected.
